Agreement

These terms are a contract between you and Philly Phones Distributors covering your use of phillyphonedistributor.com and any purchase you make on it. By using the site or placing an order you accept them, along with our Privacy Policy, Shipping Policy and Returns & Refunds Policy. If you do not agree, please do not use the site.

Eligibility and accounts

You must be at least 18 and able to enter a binding contract. Keep your password private; you are responsible for activity on your account. Tell us right away if you think it has been used without permission. We may suspend or close accounts used for fraud, abuse or resale in breach of these terms.

Products, grading and descriptions

• Phones are pre-owned unless a listing says otherwise. Each device is IMEI-checked against carrier blacklists before it ships and is sold carrier-unlocked unless the listing states a carrier.
• Cosmetic grades: Grade A — excellent condition with minimal signs of use; Grade B — fully working with visible light wear; Grade C — fully working with heavier wear. Every device is tested to be fully functional regardless of grade, and the battery health minimum shown on the listing is guaranteed at the time of shipping.
• Replacement parts (screens, batteries, back glass, charging ports) are sold by quality tier as described on the listing (for example Prime, Soft OLED, Hard OLED). Parts are intended for installation by someone with repair experience.
• Product photos are representative. Storage, color, carrier lock and grade are as stated on the listing at the time of purchase.
• Unless a listing says "new", accessories may be generic or third-party products; brand names are used to describe compatibility.

Prices and availability

Prices are in US dollars and can change without notice; the price charged is the one shown when you place the order. Inventory is live and shared with our wholesale customers, so an item can sell out between your adding it to the cart and paying. If we cannot fulfil an item after you have paid, we will cancel that item and refund it in full. We may correct obvious pricing errors and cancel affected orders with a full refund.

Orders and payment

• Your order is an offer to buy; it is accepted when payment is confirmed and you receive the order confirmation email.
• Payment is by card through Stripe. Your card is charged when the order is placed.
• Sales tax: we collect Pennsylvania sales tax on orders shipped to Pennsylvania. Orders shipped elsewhere are not taxed by us; you are responsible for any use tax in your state.
• We may cancel an order we reasonably believe is fraudulent, placed with a stolen card, or in breach of these terms, and refund any payment taken.

Returns and refunds

Every order carries a 14-day window for defective or not-as-described items; there are no returns for any other reason. The details are in our Returns & Refunds Policy, which is part of these terms.

Wholesale accounts

Dealer (wholesale) accounts, tier pricing and credit terms are offered at our discretion after application and approval and are governed by a separate dealer agreement. Wholesale orders placed through the dealer portal or the mobile app are subject to that agreement in addition to these terms.

Acceptable use

• Do not use the site to do anything unlawful, to interfere with it, to scrape it, or to attempt to access other customers’ accounts or our systems.
• Do not resell products bought at retail prices while representing yourself as an authorised dealer; apply for a wholesale account instead.

Intellectual property

The site, its text, design and images are owned by Philly Phone Distributors or our licensors. Phone brand names, logos and model names belong to their respective owners and are used only to identify compatible products; we are not affiliated with Apple, Samsung, Google or Motorola.

Warranty and liability

Apart from the grading, functional-testing and battery-health commitments above and the rights under our Returns & Refunds Policy, products are sold "as described" and, to the fullest extent the law allows, without other warranties, express or implied, including merchantability or fitness for a particular purpose. Manufacturer warranties do not generally apply to pre-owned devices.

To the fullest extent the law allows, our total liability for any claim relating to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental or consequential losses (such as data loss, lost profits or the cost of a replacement device). Nothing in these terms limits liability that cannot be limited by law, including your statutory consumer rights.

Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania. We will always try to resolve a problem directly first — contact us. Any dispute that cannot be resolved will be brought in the state or federal courts located in Philadelphia County, Pennsylvania, and you consent to their jurisdiction.

Changes to these terms

We may update these terms; the version in force is the one posted here when you place an order. Continued use of the site after a change means you accept it.
